DART MOTORSPORT LIMITED

TERMS AND CONDITIONS

Last updated: September 2026

These Terms and Conditions apply to goods and services supplied by DART MOTORSPORT LIMITED, trading as DART Motorsport (“DART”, “we”, “us” or “our”).

Company number: 13523509
Registered office: Beaumara Ltd, High Street, Attleborough, Norfolk, United Kingdom, NR17 2EH
Trading address: Tower Industrial Estate, Near Brands Hatch, London Road, Sevenoaks, Kent, TN15 7NS
Telephone: 0345 163 1111
Website: www.dartmotorsport.com

These Terms apply, where relevant, to workshop services, servicing, repairs, diagnostics, engine work, performance modifications, dyno testing, ECU remapping and tuning, race and track preparation, parts and accessories, online sales, motorcycle sales and other goods or services supplied by DART Motorsport.

Nothing in these Terms affects any statutory rights which a consumer is entitled to under applicable law.

1. ABOUT THESE TERMS

1.1 These Terms form part of the contract between DART Motorsport and the customer.

1.2 Different provisions may apply depending on whether you are:

(a) a consumer, meaning an individual acting wholly or mainly outside their trade, business, craft or profession; or

(b) a business customer, meaning a person or organisation acting for purposes relating to their trade, business, craft or profession.

1.3 Where mandatory consumer law gives a consumer rights or remedies which cannot lawfully be excluded or restricted, those rights and remedies will apply notwithstanding anything in these Terms.

1.4 By placing an order, accepting a quotation or estimate, confirming a workshop booking, paying a deposit, or instructing us to begin work, you agree to these Terms.

2. QUOTATIONS, ESTIMATES AND PRICES

2.1 Prices displayed on our website, advertisements or other promotional material may change from time to time and do not necessarily constitute a binding quotation.

2.2 Where we provide an estimate, it is our reasonable assessment of the likely cost of the work based on the information and condition of the motorcycle or other item reasonably apparent at that time.

2.3 An estimate may need to change where, for example:

(a) further faults or damage are discovered;

(b) dismantling or diagnostic work reveals additional work is required;

(c) parts or components differ from those reasonably expected;

(d) previous repairs or modifications affect the work required; or

(e) circumstances arise which could not reasonably have been identified before work commenced.

2.4 We will obtain the customer's approval before carrying out additional work which would increase the agreed estimate.

2.5 Approval for additional work may be given in person, by telephone, email, text message, WhatsApp or another agreed communication method. We may keep a record of that approval.

2.6 If additional work is recommended and the customer declines it, we may stop work where we reasonably believe continuing would be unsafe, inappropriate, technically unsound or likely to cause damage.

2.7 Where reasonably practicable, we will explain the consequences of declining recommended work.

3. WORKSHOP BOOKINGS

3.1 A request submitted through our website, telephone, email, WhatsApp, social media or in person is a booking request unless and until DART Motorsport confirms the booking.

3.2 Workshop dates and estimated completion dates are given in good faith. Unless expressly agreed otherwise, they are estimates rather than guaranteed deadlines.

3.3 Delays can occur because of matters outside our reasonable control, including parts availability, additional faults discovered during work, specialist subcontract work, supplier delays and the complexity of diagnosis or repair.

3.4 Customers must provide accurate information about the motorcycle and disclose any known faults, previous damage, engine modifications, ECU modifications, tuning, competition use or other circumstances which may reasonably affect the work.

3.5 We may refuse or postpone work where we reasonably consider that a motorcycle is unsafe, unsuitable for the requested work or requires other work before the requested service can safely be undertaken.

4. WORKSHOP DEPOSITS

4.1 DART Motorsport may require a deposit before accepting or commencing workshop work.

4.2 The requirement for a deposit and its amount may be determined by the technician or DART Motorsport having regard to the nature of the job, parts required, labour involved and other relevant circumstances.

4.3 We may require advance payment for parts, special-order components, externally supplied services or a reasonable proportion of anticipated labour before commencing or continuing work.

4.4 Any deposit or advance payment will normally be credited against the final invoice.

4.5 If a customer cancels work after parts have been specially ordered, work has commenced or DART Motorsport has otherwise incurred costs specifically for that customer's job, we may deduct or retain an amount representing our reasonable direct loss, subject to the customer's statutory rights.

5. DYNO TUNING AND MAPPING BOOKINGS

5.1 A £100 deposit is required to secure a confirmed dyno tuning or ECU mapping booking unless DART Motorsport expressly agrees otherwise.

5.2 The deposit will be credited against the final invoice.

5.3 A customer who fails to attend a confirmed dyno or mapping appointment without giving reasonable notice may lose some or all of the £100 deposit where, and to the extent that, this reasonably reflects DART Motorsport's direct loss arising from the missed booking, including reserved dyno or technician time that could not reasonably be reallocated.

5.4 If we are able reasonably to reduce our loss, for example by reallocating the appointment, this will be taken into account when determining any amount retained.

5.5 Nothing in this section limits any cancellation rights which a consumer has under applicable law.

6. CANCELLATIONS, RESCHEDULING AND NO-SHOWS

6.1 Customers should notify us as soon as reasonably possible if they cannot attend an appointment.

6.2 If a customer cancels, reschedules or fails to attend a workshop appointment, the original workshop slot is lost.

6.3 Any replacement appointment will be offered according to our next available workshop availability. The customer will not retain their former position in the workshop schedule or queue.

6.4 Where a deposit has been paid, any amount retained following cancellation or non-attendance will be subject to applicable consumer law and will not exceed an amount reasonably reflecting DART Motorsport's direct loss.

6.5 If DART Motorsport needs to cancel or rearrange an appointment, we will endeavour to give reasonable notice and arrange an alternative date.

7. DIAGNOSTIC WORK

7.1 Diagnostic work is a chargeable service in its own right.

7.2 Payment for authorised diagnostic time is due even where:

(a) no fault is ultimately identified;

(b) the fault is intermittent;

(c) further investigation is recommended;

(d) the customer decides not to proceed with a repair; or

(e) diagnosis establishes that repair is uneconomic or requires work outside the original instruction.

7.3 Where further diagnostic work would exceed an agreed estimate, we will seek the customer's approval before proceeding.

7.4 Diagnosis is based on the information, symptoms and condition reasonably available at the time. Some faults may require staged investigation or may only become apparent after other faults have been rectified.

8. PARTS AND COMPONENTS

8.1 DART Motorsport does not fit customer-supplied parts or components.

8.2 Parts required for work undertaken by DART Motorsport must therefore be supplied or sourced by us unless we expressly agree otherwise in writing in exceptional circumstances.

8.3 This policy enables us to maintain appropriate control over component suitability, provenance, quality and installation.

8.4 Parts availability and delivery dates supplied by manufacturers, distributors and other suppliers are outside our direct control.

8.5 Special-order, bespoke or specifically sourced parts may require payment in advance.

8.6 Where removed parts are required for warranty assessment, exchange, surcharge/core return or must be returned to a supplier or manufacturer, those parts may not be available to the customer.

8.7 Otherwise, if a customer wants replaced components returned to them, they should tell us before the work is completed. Components may be disposed of after completion if no request has been made.

9. CUSTOMER-SUPPLIED INFORMATION AND PRE-EXISTING CONDITIONS

9.1 Customers must tell us about relevant previous work, known defects, accident damage, competition use, modifications and other information which could reasonably affect the work requested.

9.2 DART Motorsport is not responsible for a pre-existing fault, defect, weakness or damage merely because it becomes apparent while the motorcycle is in our possession.

9.3 Where work exposes or reveals an existing defect, we will where reasonably practicable notify the customer and obtain approval before carrying out additional chargeable work.

9.4 Nothing in this section excludes responsibility for loss or damage caused by DART Motorsport failing to exercise reasonable care and skill or where responsibility cannot otherwise lawfully be excluded.

10. DYNO TESTING, ECU REMAPPING AND PERFORMANCE WORK

10.1 Dyno testing, engine testing, ECU calibration, remapping and performance development may require a motorcycle and its engine, transmission and associated systems to operate under significant load, speed, temperature and/or engine RPM.

10.2 Customers must disclose any known mechanical, electrical or electronic faults and any relevant modifications before testing or tuning begins.

10.3 The customer is responsible for ensuring, so far as reasonably known to them, that the motorcycle presented for dyno or performance work is in suitable mechanical condition.

10.4 We may inspect a motorcycle before dyno testing, but such an inspection is not necessarily a comprehensive mechanical inspection and should not be treated as confirmation that every component is free from defects.

10.5 We may refuse or discontinue dyno testing or tuning if we reasonably consider the motorcycle unsafe or unsuitable to continue.

10.6 Performance testing can expose an existing or developing weakness which was not reasonably apparent beforehand. DART Motorsport will not be responsible merely because such a pre-existing or developing defect becomes apparent during properly performed testing.

10.7 This does not exclude DART Motorsport's responsibility where damage is caused by our negligence, breach of contract, failure to exercise reasonable care and skill or another liability which cannot lawfully be excluded.

11. ECU TUNING AND MODIFICATIONS

11.1 ECU tuning and performance modifications may alter a motorcycle from its original manufacturer's specification.

11.2 The effect of modifications can depend on the combination of components fitted, fuel used, software versions, mechanical condition and other factors.

11.3 Unless expressly agreed otherwise, DART Motorsport does not guarantee a particular horsepower, torque figure, lap time, fuel economy or other performance outcome.

11.4 Any performance figures discussed before work begins are estimates unless expressly stated otherwise in writing.

11.5 Dyno figures may vary between different dynamometers and according to atmospheric conditions, tyre condition, calibration methods and other variables.

11.6 Customers are responsible for ensuring that any modification they request is appropriate for their intended use and complies with any legal, insurance, competition or regulatory requirements applicable to them.

11.7 Customers should inform their insurer of modifications where required by their insurance policy.

12. RACE, TRACK AND COMPETITION MOTORCYCLES

12.1 DART Motorsport works on road, track and competition motorcycles.

12.2 Motorsport and track use place substantial demands on motorcycles and their components. Component life can be materially shorter than under ordinary road use.

12.3 Unless expressly agreed in writing, we do not guarantee that a motorcycle or component will complete any particular race, track day, championship, event or period of competition use without failure.

12.4 Setup, tuning or preparation by DART Motorsport does not remove the customer's or rider's responsibility to conduct appropriate pre-use checks and maintain the motorcycle according to its intended use.

12.5 Where work is performed to comply with particular technical or competition regulations, the customer must tell us which regulations apply. Unless expressly agreed as part of our instruction, ultimate responsibility for confirming eligibility for an event or championship remains with the entrant/rider.

12.6 Nothing in this section excludes liability which cannot lawfully be excluded.

13. ROAD LEGALITY AND USE OF MODIFIED MOTORCYCLES

13.1 Some parts, modifications, exhaust systems, ECU settings or competition components may not be suitable or lawful for use on public roads.

13.2 Where a customer requests parts or work intended solely for closed-course, race or competition use, the customer is responsible for using the motorcycle accordingly.

13.3 Nothing in these Terms should be interpreted as authorising the unlawful use of a motorcycle on a public road.

14. PAYMENT FOR WORKSHOP SERVICES

14.1 Unless expressly agreed otherwise, all parts, labour and other authorised charges are payable in full on or before collection of the motorcycle.

14.2 We may require payment before releasing a motorcycle, parts or other property to the customer.

14.3 Payment may be made using the payment methods accepted by DART Motorsport at the relevant time.

14.4 The customer should raise any query regarding an invoice promptly. The existence of a query does not automatically entitle the customer to withhold sums which are not genuinely disputed.

15. COMPLETION, COLLECTION AND STORAGE

15.1 We will notify the customer when their motorcycle is ready for collection using the contact details supplied to us.

15.2 Customers should arrange collection promptly.

15.3 A motorcycle may be stored without a storage charge for 3 working days after we first notify the customer that it is ready for collection.

15.4 For this purpose, a working day means a day on which the DART Motorsport workshop is ordinarily open for business, excluding public holidays.

15.5 If the motorcycle has not been collected by the end of that period, a storage charge of £10 per calendar day may be applied from the following day until collection.

15.6 Storage charges must be paid together with all other outstanding sums before collection.

15.7 If a motorcycle remains uncollected for an extended period, we may take reasonable steps permitted by law to secure payment and/or deal with the uncollected motorcycle. We will give any notice required by law before taking such action.

16. CUSTOMER PROPERTY

16.1 Customers should remove cash, valuables and unnecessary personal property from a motorcycle before leaving it with us.

16.2 We will exercise reasonable care in looking after motorcycles and property left in our possession.

16.3 We are not responsible for loss caused by circumstances outside our reasonable control except where applicable law provides otherwise.

17. TEST RIDES AND OPERATION OF MOTORCYCLES

17.1 By leaving a motorcycle with DART Motorsport for work, the customer authorises our appropriately qualified or experienced personnel to start, move, operate and, where reasonably necessary for diagnosis, testing or verification of work, test ride the motorcycle.

17.2 Test rides will only be undertaken where reasonably relevant to the work being carried out.

17.3 Dyno operation and workshop testing may also be undertaken where reasonably required for the authorised work.

18. SUBCONTRACTORS AND SPECIALIST SERVICES

18.1 We may use appropriately selected third parties for specialist services where reasonably necessary, for example machining, specialist testing or component refurbishment.

18.2 Where we contract with a third party as part of supplying our service to a consumer, this does not remove any responsibility DART Motorsport has to the consumer under applicable law.

19. WORKMANSHIP AND REMEDIAL WORK

19.1 DART Motorsport will perform workshop services with the standard of care and skill required by applicable law.

19.2 If a customer believes there is a problem with work performed by us, they should contact us promptly and give us a reasonable opportunity to inspect the motorcycle and investigate the concern.

19.3 Where we are responsible for defective workmanship, we will provide the remedy required by applicable law, which may include repeating or rectifying the relevant service where appropriate.

19.4 We are not responsible for problems caused by:

(a) normal wear and tear;

(b) misuse, accident or neglect after collection;

(c) subsequent work or alteration carried out by another person;

(d) a pre-existing defect unrelated to our work;

(e) customer failure to follow reasonable maintenance or operating instructions; or

(f) competition or other extreme use, except to the extent that the problem results from a breach by DART Motorsport of its legal obligations.

19.5 Manufacturer or supplier warranties applying to parts are subject to their applicable terms, but this does not reduce any statutory rights the customer has against DART Motorsport.

20. ONLINE AND DISTANCE SERVICE BOOKINGS

20.1 Where a consumer enters into a qualifying service contract with us entirely online, by telephone or by another distance method, they may have a statutory right to cancel the contract within 14 days after the day on which the contract is entered into, subject to applicable exceptions.

20.2 Merely submitting an enquiry or booking request does not itself necessarily create a contract. A contract will arise when the booking or work is accepted or confirmed by DART Motorsport, as applicable.

20.3 Where a consumer asks us to begin providing services during a statutory cancellation period, we may require their express request to begin work early.

20.4 If the consumer subsequently exercises a statutory right to cancel after expressly requesting that work begin during the cancellation period, they may be required to pay an amount proportionate to the services supplied up to cancellation, where permitted by law.

20.5 Where a service has been fully performed following the consumer's express request to begin during the cancellation period and the consumer has given any acknowledgement required by law, their statutory cancellation right may end once the service has been fully performed.

20.6 These provisions do not affect any other statutory cancellation rights or exceptions which apply.

21. ONLINE SALES OF GOODS

21.1 Where goods are purchased from our website, the customer's order is an offer to purchase the goods.

21.2 A contract is formed when we accept the order, subject to availability, payment and any other applicable conditions communicated during checkout.

21.3 Product photographs, descriptions and specifications are intended to describe the goods accurately, but minor variations which do not materially affect the goods may occur.

21.4 Customers are responsible for checking compatibility and suitability before ordering unless DART Motorsport has expressly agreed to determine suitability for a specified motorcycle.

21.5 Where a consumer purchases goods online, statutory cancellation rights may apply. Nothing in these Terms reduces those rights.

21.6 Goods must be of satisfactory quality, fit for any particular purpose made known to us where the law requires, and as described, subject to applicable consumer law.

22. DELIVERY OF GOODS

22.1 Delivery times are estimates unless we expressly agree a guaranteed delivery date.

22.2 We are not responsible for delays outside our reasonable control, but this does not affect a consumer's statutory rights relating to delivery.

22.3 The customer is responsible for providing a complete and accurate delivery address.

22.4 Any delivery charges will be communicated before the order is completed.

23. RETURNS AND CANCELLATION OF ONLINE GOODS ORDERS

23.1 Consumers purchasing goods at a distance may have a statutory right to cancel qualifying purchases within the applicable cancellation period.

23.2 Any statutory exclusions from the right to cancel will apply, including where applicable to goods made to the customer's specification, clearly personalised goods or other categories excluded by law.

23.3 A consumer exercising a statutory right to cancel must notify us clearly of their decision.

23.4 Goods should be returned in accordance with the return instructions provided by DART Motorsport.

23.5 A consumer may be responsible for return costs where permitted by law and where they have been informed of that responsibility.

23.6 We may make a deduction for diminished value where goods have been handled beyond what is necessary to establish their nature, characteristics and functioning, where permitted by law.

23.7 Nothing in this section affects rights relating to faulty, damaged, misdescribed or otherwise non-conforming goods.

24. MOTORCYCLE SALES

24.1 Where DART Motorsport sells a motorcycle, the description, price, mileage where applicable, condition and any specific terms relating to that motorcycle will be set out in the relevant sales documentation.

24.2 Used motorcycles may show reasonable wear consistent with their age, mileage, previous use and description.

24.3 Nothing in these Terms excludes or restricts statutory rights relating to motorcycles sold to consumers.

24.4 Where a motorcycle is sold specifically as a competition or track motorcycle, its intended use and any material limitations known to us will be identified where appropriate.

24.5 Any part-exchange valuation may be revised if information supplied by the customer is inaccurate or if inspection reveals material faults, damage, finance, provenance issues or other circumstances which were not disclosed when the valuation was given.

25. WARRANTIES AND MANUFACTURER WARRANTIES

25.1 Certain goods may carry a manufacturer's warranty.

25.2 Manufacturer warranties are additional to, and do not replace or reduce, a consumer's statutory rights against DART Motorsport where those rights apply.

25.3 Warranty claims may require inspection, testing and/or return of the relevant component to the manufacturer or supplier.

25.4 A warranty claim cannot be determined solely from the existence of a subsequent fault; reasonable investigation may be required to establish its cause.

26. LIABILITY

26.1 Nothing in these Terms excludes or restricts liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or a consumer's statutory rights which cannot lawfully be excluded.

26.2 For consumer customers, we do not exclude or restrict our liability for failing to perform services with reasonable care and skill or for supplying goods which do not meet applicable statutory requirements.

26.3 We are responsible for loss or damage which is a foreseeable result of our breach of contract or failure to exercise reasonable care and skill, subject to applicable law.

26.4 We are not responsible for losses which were not reasonably foreseeable when the contract was made, except where the law provides otherwise.

26.5 If the customer is a consumer, we are not responsible for business losses arising from a consumer contract, including loss of profit, loss of business, loss of opportunity or business interruption.

26.6 For business customers only, and to the fullest extent permitted by law, DART Motorsport will not be liable for indirect or consequential loss or for loss of profit, revenue, business, anticipated savings or opportunity.

26.7 Nothing in this section transfers responsibility to the customer for damage actually caused by DART Motorsport's negligence or breach of its legal obligations.

27. EVENTS OUTSIDE OUR REASONABLE CONTROL

27.1 We will not be responsible for delay or failure caused by events outside our reasonable control.

27.2 Such events may include severe weather, fire, flood, epidemic, industrial action, interruption of utilities or communications, supplier or transport disruption, governmental action and similar events which we could not reasonably prevent.

27.3 We will take reasonable steps to minimise the effect of such events and will communicate material delays where reasonably practicable.

27.4 Nothing in this section affects statutory rights to cancel or obtain a refund where those rights arise.

28. WEBSITE USE

28.1 Website content is provided for general information and to describe our products and services.

28.2 Technical articles, guides, videos, social media content and other information provided by DART Motorsport are not a substitute for inspection of a particular motorcycle or professional advice relating to a specific mechanical situation.

28.3 Customers should not undertake work beyond their competence or use general website information as a substitute for appropriate workshop procedures, safety equipment or manufacturer instructions.

29. INTELLECTUAL PROPERTY

29.1 Unless otherwise stated, intellectual property in the DART Motorsport website, branding, photographs, graphics, videos and original written material belongs to DART Motorsport or is used by us with permission.

29.2 Content may not be reproduced commercially without our permission except where permitted by law.

30. PERSONAL INFORMATION

30.1 We process personal information in accordance with our Privacy Policy and applicable data protection law.

30.2 We may use customer contact details where reasonably necessary to administer bookings, obtain authority for work, provide updates, issue invoices, arrange collection, deal with warranty matters and otherwise perform our contract.

30.3 Marketing communications will be handled in accordance with applicable law and the preferences or permissions provided by the customer.

31. COMMUNICATION

31.1 Customers are responsible for providing accurate contact details and notifying us if those details change.

31.2 Where approval or notification is required under these Terms, communication may take place by telephone, email, text, WhatsApp or another method normally used between DART Motorsport and the customer.

31.3 Customers should respond promptly where work has been stopped pending approval.

32. COMPLAINTS

32.1 We aim to resolve concerns fairly and promptly.

32.2 Customers who have a concern about goods or services supplied by DART Motorsport should contact us as soon as reasonably possible, providing relevant details and giving us a reasonable opportunity to investigate.

32.3 Complaints may be made using the contact details published on our website.

32.4 Nothing in our complaints process restricts a consumer's statutory rights or right to seek an appropriate legal remedy.

33. CHANGES TO THESE TERMS

33.1 We may update these Terms from time to time.

33.2 The Terms applicable to a particular order or workshop contract will normally be those in force when that contract was made, unless a change is required by law or is expressly agreed with the customer.

34. SEVERABILITY

34.1 If any provision of these Terms is found by a court or other competent authority to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply.

34.2 Nothing in this section permits an unfair or unlawful consumer term to be replaced with a provision which would itself be unfair or unlawful.

35. THIRD-PARTY RIGHTS

35.1 Except where expressly provided otherwise, no person other than DART Motorsport and the customer has a right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.

36. GOVERNING LAW AND JURISDICTION

36.1 These Terms and contracts made under them are governed by the laws of England and Wales.

36.2 If the customer is a consumer resident elsewhere in the United Kingdom, they retain any mandatory protections and rights regarding jurisdiction which applicable law gives them.

36.3 Subject to those consumer rights, the courts of England and Wales will have jurisdiction over disputes arising from these Terms or contracts made under them.
